UPDATE: Judge Tosses Wolff Suit, Clearing Path For $1B Melania Claim

Judge Dismisses Michael Wolff’s Lawsuit Against Melania Trump, Citing Courtroom Tactics

A federal judge has dismissed journalist and author Michael Wolff’s lawsuit against First Lady Melania Trump, ruling that the dispute should proceed in state court rather than remain in the federal judicial system. Manhattan federal judge Mary Kay Vyskocil criticized the legal maneuvering involved in the case, describing it as “contorted” and questioning the way federal court procedures had been used.

Judge Vyskocil, who was appointed by President Donald Trump, acknowledged that the parties had a genuine legal dispute. However, she concluded that the federal court was not the appropriate venue to continue handling the matter. Her decision focused on jurisdiction and courtroom procedure rather than determining whether the underlying defamation allegations were true or false.

The dispute stems from statements and reporting connecting Melania Trump to discussions surrounding convicted sex offender Jeffrey Epstein, who died in federal custody in 2019 while awaiting trial on sex-trafficking charges. Melania Trump has denied any association with Epstein and has rejected statements she considers defamatory.

Her legal team, led by attorney Alejandro Brito, had sought to move the case from state court to federal court. Judge Vyskocil ultimately declined to keep the dispute in the federal system, leaving the parties to pursue the matter through the appropriate state-court process.

A spokesperson for the first lady said she remained committed to challenging statements she considers malicious and defamatory. Her legal representatives have argued that the allegations caused significant reputational and financial harm.

Wolff, meanwhile, has maintained that the threat of costly litigation can discourage journalists and critics from discussing matters involving powerful public figures. His position in the dispute has been that he did not accuse Melania Trump of participating in Epstein’s criminal activities.

The controversy gained additional attention after The Daily Beast retracted an article based on an interview with Wolff. The article had suggested that Melania Trump played a significant role in the Epstein controversy. Wolff has maintained that his comments concerned her alleged behind-the-scenes role in managing the issue at the White House, rather than involvement in criminal conduct.

The broader Epstein controversy continues to generate calls for transparency and accountability. Some lawmakers have advocated additional public hearings and opportunities for victims to testify, while others have expressed support for Melania Trump’s public statements on the issue.

Melania Trump has called on Congress to take action and urged lawmakers to provide Epstein’s victims with an opportunity to testify under oath. Her position has added another dimension to the continuing public debate over accountability, transparency, and the treatment of survivors.

The key legal distinction is that the dismissal concerned where the dispute should be litigated, not whether the underlying allegations were established. It should not be interpreted as a final determination that either party’s claims were proven true or false. The current status of the litigation and the precise language of the court’s order should be confirmed through official court records before publication.
